How Maryland approaches custody

Maryland courts consider the fitness of each parent, the character and reputation of the parties, the child’s preference where the child is of sufficient age and capacity, the potential for maintaining natural family relations, material opportunity, the child’s age, health and residence, the length of any separation from a parent, and any prior voluntary abandonment or surrender of custody. Where parents seek shared physical custody, the court also looks at the practical questions — the parents’ ability to communicate, geographic proximity, work schedules, and the effect on state and federal assistance.

Where abuse or neglect is alleged

Maryland law requires a court to give specific attention to custody and visitation where it has reasonable grounds to believe a child has been abused or neglected by a party. This is not a discretionary consideration the court may pass over; a finding on the question shapes what visitation, if any, is ordered and on what conditions. Both the parent raising the concern and the parent facing the allegation need a record a judge can evaluate.

Child support above the schedule

Maryland applies an income shares child support model with a guideline schedule. Above the top of the schedule, the amount is committed to the court’s discretion, and the argument becomes evidentiary: what the child’s actual needs are, what the household standard of living has been, and what each parent’s income genuinely is once compensation beyond salary is accounted for.
