The joint custody preference

District law directs courts to presume that joint custody is in the child’s best interests, subject to rebuttal. The presumption is not a guarantee of equal time and it is not a finding about any particular schedule; it is a starting point that a parent seeking a different arrangement must overcome with evidence. Certain findings — including judicial findings of intrafamily violence, child abuse, child neglect or parental kidnapping — operate against the presumption.

What rebuts it

In practice the presumption is rebutted the same way any custody position is established: with documentation, third-party witnesses and professional reports rather than characterizations. Communication failure between parents, a demonstrated pattern of unilateral decision-making, geographic distance that makes shared physical custody impractical, and safety findings all bear on the question. A parent who argues only that the other parent is difficult usually has not met the burden.

Code § 16-910 governs the distribution of property on divorce or annulment, requiring the court to assign each party their sole and separate property and to value and distribute all other property accumulated during the marriage in a manner that is equitable, just and reasonable after considering all relevant factors. D.C. Code § 16-904 sets the ground for divorce.
